Meningkatkan Integritas Sistem Hukum dalam Pemberantasan Korupsi melalui Pancasila sebagai Dasar Reformasi Hukum

Abstract

Kajian ini dilatarbelakangi oleh realitas pemberantasan korupsi yang kerap terjebak pada proseduralisme legal tanpa fondasi etis yang kokoh, sehingga hukum kehilangan daya korektif dan hanya menjadi instrumen transaksional. Tujuannya adalah merumuskan kerangka konseptual dan praktis untuk meningkatkan integritas sistem hukum dalam pemberantasan korupsi dengan menempatkan Pancasila tidak sekadar sebagai landasan filosofis, tetapi sebagai perangkat etik yang hidup dan operasional. Metode kajian ini menggunakan library research dengan pendekatan kualitatif normatif yang memadukan literatur, peraturan, dan kasus relevan untuk menegaskan urgensi integrasi Pancasila sebagai living law yang transformatif dalam reformasi hukum Indonesia. Hasilnya menyatakan bahwa pemberantasan korupsi di Indonesia tidak akan pernah mencapai efektivitas substansial jika hanya bertumpu pada perangkat hukum yang kaku dan prosedural tanpa menanamkan roh nilai Pancasila sebagai basis etika sistemis dalam seluruh tubuh hukum negara. Pancasila harus diredefinisi bukan sekadar sebagai landasan filosofis, melainkan sebagai legal ethics yang membentuk struktur kesadaran aparat hukum, mengarahkan logika legislasi, dan menjadi filter moral dalam proses yudisial. Jika tidak, maka bangsa ini hanya akan terus memelihara kontradiksi antara ideologi agung dan praktik hukum yang rapuh, menjadikan Pancasila sekadar monumen tekstual tanpa daya transformatif.
