MAHKAMAH KONSTITUSI DAN PENGOKOHAN DEMOKRASI KONSTITUSIONAL DI INDONESIA
Abstract
The authorities and obligation of The Constitutional Court of
The Republic of Indonesia based on Article 24C of the 1945
Constitution are very close to the ideas and the implementation
of democracy. This is related to the fact that the establishment
of The Court is intended to provide assurance of strengthening
constitutional democracy as well as maintaning checks and
balances between branches of the state power. One of the things
that can be observed is after The Court’s establishment,
awareness both in The House of Representatives and The
President are emminent whereby that laws shall be formed by
observing the norms of democracy and human rights, and shall
not be contradictory to the 1945 Constitution, as the supreme
law of the land. The House and The President shall assume
that when there is a part of the article or even the entire law
decided by The Court is in contradictory to the 1945 Constitution
and therefore does not have any legally binding force, it is
considered a dark political note which can reduce their
credibility in public image. This is the probably one of the
successes of the Constitutional court within the Indonesian state
system.
