Meneroka Prospek Sunset Clause: Urgensi dan Rambu Penerapannya di Indonesia
Abstract
Artikel ini menganalisis prospek penerapan sunset clause di Indonesia sebagai instrumen untuk menetralisir efek negatif dari legislasi darurat. Secara substantif, kajian menelusuri lebih jauh mengenai dua isu, yakni urgensi pengadopsian dan rambu penerapan sunset clause dalam pembentukan hukum. Dengan menggunakan penelitian normatif, analisis diawali dengan mengungkap urgensi penerapan sunset clause. Hal ini ditelaah berdasarkan pengalaman selama Covid-19 yang menunjukkan banyak peraturan beraksentuasi menderogasi hak asasi manusia, sehingga perlu diberlakukan sementara dan tetap dievaluasi secara berkala. Bagian selanjutnya dari artikel ini menyajikan hasil penelusuran berbagai praktik penerapan sunset clause. Di sisi lain, juga mengulas peraturan yang semestinya memuat klausul sunset, baik dalam kondisi alamiahnya maupun potensi ekstensifikasinya di Indonesia. Sajian akhir pada bagian ini adalah mengungkap berbagai limitasi yang perlu menjadi pedoman agar penerapan sunset clause tidak diberlakukan secara serampangan dan dapat menjadi instrumen yang efektif dalam mencapai tujuan utamanya. Signifikansi dari kajian yang dilakukan telah membuka ruang baru bagi pengkajian lebih lanjut terhadap prospek sunset clause di Indonesia, terutama kaitannya dengan sistem konstitusi dan good governance.
