DILEMA HAK PERLINDUNGAN DATA PRIBADI DAN PENGAWASAN SIBER: TANTANGAN DI MASA DEPAN

Abstract

Penelitian ini berfokus pada perdebatan pengawasan siber dalam kerangka keamanan nasional dan resistensinya terhadap hak perlindungan data pribadi yang kemudian memunculkan dilema. Tujuan dari penelitian ini adalah untuk menganalisis bagaimana pengawasan siber digunakan oleh negara-negara sebagai sistem/perangkat pencegahan untuk menghadapi berbagai ancaman terhadap keamanan nasional. Akhirnya, resistensi masyarakat terhadap fenomena ini dan implikasinya diperiksa, terutama menyangkut privasi atas data pribadi sebagai bagian dari hak asasi manusia yang merupakan prinsip yang dijunjung tinggi dalam negara demokrasi seperti Indonesia. Untuk mendapatkan hasil yang komprehensif, penelitian ini menggunakan pendekatan kualitatif dengan metode studi kasus, yang datanya dikumpulkan melalui studi pustaka dan dokumen. Hasil penelitian dan pembahasan dalam penelitian ini sesuai dengan permasalahan yang dijadikan fokus penelitian sehingga didapati hal-hal sebagai berikut: Pertama, lanskap pengawasan siber berubah di seluruh dunia pasca 9/11, di mana kekhawatiran tentang privasi atas data pribadi dan kebebasan sipil dikalahkan oleh kekhawatiran tentang keamanan. Dengan alasan kontraterorisme, sekuritisasi dengan menggunakan teknologi siber diperkenalkan dan semakin dilegitimasi, sementara populasi didisiplinkan untuk secara sukarela menerima sistem ini sebagai “harga untuk keamanan”. Kedua, penekanan pada peran penting yang dimainkan oleh lembaga perlindungan data independen dalam memastikan implementasi undang-undang yang efektif yang dirancang untuk melindungi informasi yang dapat diidentifikasi secara pribadi.
