Media Baru dan Kelompok Rentan dalam Proses Legislasi: Studi Kasus Deliberasi Undang-Undang Nomor 12 Tahun 2022 tentang Tindak Pidana Kekerasan Seksual

Abstract

Walaupun proses legislasi tidak dapat lepas dari proses komunikasi, tetapi aspek komunikasi justru sering diabaikan dalam mekanisme legislasi. Pengabaian aspek komunikasi dimulai sejak penyusunan dan pembahasan rancangan undang-undang ketika masyarakat – khususnya kelompok rentan atau minoritas – tidak memiliki akses terhadap perkembangan legislasi. Penelitian ini menganalisis praktik pemanfaatan media baru dalam membuka ruang deliberasi bagi kelompok rentan dengan studi kasus pada proses pembentukan UU Tindak Pidana Kekerasan Seksual. Penelitian ini menggunakan teori demokrasi deliberatif dalam melihat media baru sebagai ruang publik kontemporer yang inklusif bagi kelompok rentan. Hasil penelitian menunjukkan bahwa perempuan sebagai kelompok yang rentan mengalami kekerasan seksual telah mencoba untuk memanfaatkan media baru sebagai instrumen advokasi atas hak-hak korban. Pemanfaatan media baru tersebut melalui petisi daring, forum-forum webinar yang disebarluaskan, dan kampanye di media sosial melalui pesan-pesan untuk mengajak dukungan terhadap UU Tindak Pidana Kekerasan Seksual. Dalam perkembangan berikutnya, media baru akan menjadi makin relevan dalam menggerakkan aktivisme dan advokasi legislasi.
